Acceptance

Please note that by submitting your payment for our services, you are agreeing to these terms of design service as written here. Joy Kelley {HowJoyful Design Studio} reserves the right to change or update these terms at any time without prior notice.

Payment

• For any projects or design work under $600.00, HowJoyful Design Studio requires 100% of total payment in advance before work ever begins.
• For projects between $600.00 and $1,500.00 HJD Studio requires a 50% deposit before the beginning of the project, and the remaining 50% once the design has being approved, prior to installation or delivery of files.

All amounts must be in US Dollars (US$) invoices will be sent to client with the arranged due date at the beginning of the project.

Refunds

We do everything possible to satisfy our clients needs, but if a refund is requested, the client will have to pay for all revisions sent ( $80.00 each) and the remaining amount will be refunded to the client depending on how the payment was made… no questions ask. We also request clients to respect the property right and not use any of the revised sketches sent due to the fact that they belong to HowJoyful Design Studio. Negotiations for full refunds will not be accepted. As clearly stated, all clients are asked to read and agree to these terms of service prior to the commencement of any project.

Authorization

The client is engaging HowJoyful Design Studio as an independent contractor for the project discussed.
We will never ask you for your personal passwords or account information on a remote server. This information may sometimes be required for certain services (such as installation, configuration and products), however we would prefer that you create temporary accounts or passwords for our use. The client hereby authorizes HowJoyful Design Studio with full access to all necessary materials, accounts, resources and programs for project completion. HowJoyful Design Studio will not share or sell this information, nor are we to be held responsible for any damage or loss of data.

Penalty fees

Sketches of your custom design will be made to guarantee your satisfaction, but only up to a determined number of drafts (depending on the service). If you require more than the listed number of sketches or revisions, you will be charged with a fee of $20.00 per sketch revision. Therefore HowJoyful Design Studio requests you to be as explicit as possible about the changes required every time a sketch is sent to you.

Copyright & Trademark

The client unconditionally guarantees that any elements of text, graphics, photos, design, trademarks or other artwork furnished to HowJoyful Design Studio for inclusion in the project are owned by the client or that the client has permission from the rightful owner to use each of these elements and will hold harmless, protect, indemnify and defend HowJoyful Design Studio and it’s subcontractors from any liability (including attorney’s fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the client.

Liability

Any service purchased from HowJoyful Design Studio is provided ‘as is’ without warranty of any kind that the design project will be uninterrupted or error-free. In no event will HowJoyful Design Studio be liable to you or any third party, on any legal theory for any direct, indirect, special, incidental, punitive, exemplary or consequential damages arising out of the use of any HowJoyful Design Studio service, graphic or code, or the use of any hosting service, service provider, telecommunications carrier, internet servers, third party e-commerce programs, or your blog visitor’s computer or internet software, including, without limitation, service interruptions caused by acts of God and/or Nature, or any other circumstances beyond my reasonable control, any lost profits, business interruption, loss of data or otherwise, even if expressly advised of the possibility of such damages.

Project ownership

Ownership of final artwork designed by HowJoyful Design Studio on behalf of the client will be transferred to the client after payment, unless otherwise specified by HowJoyful Design Studio. This does not include code or software. Copyright on all software and code remains the property of HowJoyful Design Studio or its otherwise respective owner.

HowJoyful Design Studio will retain a copy of the design service for client for only 6 months in the event of a catastrophic event, so it is the client’s responsibility to maintain a backup of their design and data.

Downtime & Hosting

When applicable your images and files will be hosted through our hosting provider. HowJoyful Design Studio is not responsible for any downtime on their part, but if it occur please wait it out. If your images and files are not up and viewable within 8 hours feel free to contact us for an overview on the issue and an estimated time of it’s solution (we will investigate the issue but we can not guarantee a solution because we do not host images or files). If desired you may provide us with a replacement hosting provider (site and login info needed) to which I we will switch your images and files over to. In such event the client will have to pay a $30.00 fee for the migration and they will have full control of the new location but the copyright will continue to remain with HowJoyful Design Studio.

Cross browser compatibility

This agreement covers the creation of blog templates and websites viewable in the latest versions of Microsoft Internet Explorer, Mozilla Firefox, and Safari. We cannot guarantee error-free viewing in any browser that includes third-party plug-ins. Compatibility is defined herein as all critical elements of each page being viewable in these browsers. Client is aware that some Internet technologies may require a more recent browser version, operating system, and brand or plug-in. We are not responsible for browser compatibility errors a month after installation, so we request you to do all test before that time, after that we can look at your problems charging our hourly wage.

Communication & Support

Once payment has been received and the design of your blog and/or logo has commenced, you must be available via e-mail, able to answer all questions and complete tasks throughout the design process. All communication (draft corrections) are via e-mail and not by phone, fax, postal mail or in person. If you require to discuss details of your drafts by phone, please let us know with anticipation to make the proper arrangements.

You will receive support via email for 30 days after you design has been delivered. We encourage you to use this time to load your information and process several test entries to become familiar with your new design’s functionality. After 30 days, there will be a charge for hourly support ($70-$100 an hour) depending on the frequency and complexity of your questions/edits.

Credits & Usage

All graphics, illustrations, and layouts are intended to be kept whole as given to you. All work done by HowJoyful Design Studio may not be used by anyone else but the specified client on the domain for which it was originally designed. All preliminary mockups to include graphics, layouts, etc. which are not selected by the client remain the full property of HowJoyful Design Studio and may be used in future projects for other clients. HowJoyful Design Studio retains all rights to display artwork in portfolios and advertising materials. E-mail testimonials from clients may be posted as well.

All designs by HowJoyful Design Studio require a text link or a graphic link back to {www.hjdstudio.com} unless other arrangements have been made. The client guarantees that links back to HowJoyful Design Studio will remain in place until such time as that blog design is no longer published on the Internet. Removal of this link is in violation of this agreement.

Showcase

After the finalization of your project, we might include the design we created for you in our Portfolio and do a mini-feature on our site. No personal information will be shared of either the client or business. This feature is for Design purposes only and if you decide you don’t want to be included please let us know before the finalization of your project.

Free files and templates

We share printable files, free templates and tutorials to help all of you make your blog and space prettier, but please remember to respect our Freebie Terms. A lot of time and sacrifice goes into making the files and templates shared with all of you, so please give credit and never link directly to the downloable files, but to the post or pages where they are shared. Thank you.
